1. Welcome to OxMotive

By accessing or using OxMotive’s services, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.

2. Nature of Our Service

OxMotive provides a web-based CRM and iOS mobile application that allows auto service businesses to manage job workflows, customer data, and communications.
OxMotive does not perform, manage, or oversee any vehicle services. We act solely as a technology platform and are not responsible for any service outcomes, payments, or disputes between customers and businesses.

3. Third-Party Disclaimer

OxMotive serves only as a facilitator of communications and record-keeping between service providers and their customers. Invoices, text messages, and updates sent via the platform are the responsibility of the business using our software. OxMotive is not liable for damages, disputes, or claims related to services rendered.

4. Payment Terms

Users retain ownership of their data. OxMotive may access and use this data solely to provide and improve services, in accordance with our Privacy Policy.

5. Limitation of Liability

OxMotive disclaims all liability for indirect, incidental, or consequential damages arising from the use or misuse of our platform.

6. Termination

We reserve the right to suspend or terminate accounts that violate our terms, policies, or any applicable laws.

7. Governing Law

These terms are governed by the laws of Ontario, Canada, without regard to conflict of law provisions.

Privacy policy

1. What We Collect

We collect personal and vehicle information such as names, emails, phone numbers, VINs, and service history when you or your service provider use the platform.

2. Why We Collect It

To operate and improve the OxMotive platform, deliver requested features, send job related updates, and ensure system performance.

3. Data Use

We do not sell personal data. Information is shared only with necessary third-party services(e.g., email/SMS providers) under strict confidentiality agreements.

4. Data Security

We use modern security protocols (encryption, access controls, etc.) to protect your data.

5. User Rights

You may request access to or deletion of your data by contacting: support@oxmotive.co

6. Invoice & Message Content

Content in invoices or text messages is created by the service provider. OxMotive is not responsible for the accuracy, pricing, or promises made in those messages.

Accounts are for authorized users only. Sharing credentials is prohibited.

2. Responsibility for Data

Users are responsible for ensuring their uploaded data is accurate, legal, and compliant with third-party rights.

3. Prohibited Use

Users are responsible for ensuring that the data they input into the system is accurate and does not violate any laws or third-party rights.

4. Platform Role Reminder

OxMotive is a tool — not a service provider. All physical vehicle service interactions are between the customer and the auto business, not OxMotive.

Messaging & Communication Compliance

1. Consent to Electronic Communication

By using OxMotive, you consent to receive electronic communications (e.g., emails, SMS messages) related to job status, appointments, and platform activity. You may opt out at any time via unsubscribe links or by replying STOP to SMS.

2. For Service Providers Using OxMotive:
  • Valid Consent Required
    You must only send communications (SMS or email) to recipients who have opted in.
  • No Repurposing Transactional Messaging
    You may not send marketing content using OxMotive’s transactional messaging tools unless the user has explicitly agreed.
  • Unsubscribe Required
    Every email must include a working “unsubscribe” link. Every SMS must honor opt outs immediately.
  • Timely List Removal
    You must remove unsubscribed users
    o Immediately (SMS)
    o Within 10 days (email)
  • Avoid Spam Complaints
    Sending content that generates high spam/UCE (Unsolicited Commercial Email)complaints — even if not technically spam — is prohibited and may result in account suspension
3. Legal Compliance

You agree to comply with all local, national, and international regulations — including TCPA, CAN-SPAM, CASL, GDPR, or others that apply to your jurisdiction and your recipients.

4. Responsibility for Communications

You (the business) are fully responsible for the content, legality, and delivery of any messages or invoices sent via OxMotive. We are not liable for misuse of the messaging system.
